BTW, The National Inquirer, who were the first to break the story of John Edwards affair has released the Plain story as well. I am not saying that this is real story or a false rumor. I am merely saying that this is out there and the fact is, John Edwards also denied the story in the beginning. But The National Inquirer has recently gained more credibility with being right on the John Edwards story.
Just to add, Not sure if this is true but there is news that Sarah Palin cheated on her husband, and had a relationship with the business partner of her husband. If this is true, then it would imply that she is not a good mother, she not a good wife and she is cunning & opportunist politician, with very little experience and a heartbeat away from her finger on the nuclear button when she is ready to go to war with Russia. Watch some 'Sarah Palin' youtube videos and see for yourself.
Now please don't call this "deep sexism", did anyone see Dick Morris around?
There is something about politicians who cannot pronounce the word "nuclear" properly. They all seem to somehow become Presidents. Maybe we should start pronouncing the word "nuclear" differently, it may help us to us to become president. :D

Just imagine this, you spend 6 months training an international grad, spend $5000 - $7000 per H1B and after 1 - 2 yrs, you will have to start all over again. After a couple of months, the "new hire" will just be angry at you (just look at all the people on this forum who curse bodyshoppers - and just to clarify - I am not implying that the company you start will be a bodyshopping firm) and he will quit your company and join someone else. And you will have to start the process all over again. The guy who you hired on H1B will be now join someone else and depending on your business, you will be left high and dry.

Over a period of 2 months, 12 of us quit for better jobs. Guess who now had to look for 12 people and at the sametime deliver the product to the clients on time?

I had H1 from company A with dates from 2005 to 2008. after working with Company A for one year, I moved to company B in 2006 (04/10/2006) and My H1 transfer with Company B is still pending. I got H1 RFE query from CSC last month with biglist of documents. Now I got news that CSC denied couple of H1s it seems recently..So can I ask company C to file H1 transfer petition so that even if CSC denies my H1 from Company B, I can maintain my legal H1 status. Or Can I ask Company B to file another H1 transfer petition at Vermont service center (because my company is in that region).

Hi guys,
This is what my lawyer said.
If you/spouse have used your EAD or are using your EAD then your "Current Immigration Status" is "Adjustment of Status Pending/Parolee". If not then it is either H1B or H4.
If you/spouse have actually travlled outside the US and re-entered using the Advanced parole, then your "Manner of Last Entry" is "Parolee". If not then it is what it says on your I-94 (H1B or H4).
You do **NOT** need the $80 Biometric fee for the Advanced Parole.

I wonder if anybody noticed the cyclic pattern of dates for EB3 India
Every time it hit Nov 2001, the dates were made unavailable and the cycle started again from early 2001.
I wonder what is going to happen next month??
I think the cycles will stop now... you should see a steady forward progress during the first 3 quarters & a jump (minor or major depends on spillover) in last quarter...

If bill is passed Senate in 2007 it will pass current form for H1b. There is possiblity for failing of the bill is 75% now. Also even if Cantwell amendment is passed that will give relief only to high tech companies not for Hospitals or Health care. There is no other amendment other than Cantwell for H1b or GC relief in Senate

But I am almost certain that Most persons who file I485 within next 6 months will get GC within 1 to 5 years whether CIR is passed or not.

I am preparing I131 (AP) renewal application for me and my family. For my son, who is 8 years old, do I need to fill "Part 9. Signature of Person preparing the form, if other than the applicant" since I am preparing this form? OR can I just sign Part 8 on-behalf of my son?
G-28 form says it needs to be filled in case if you use Attorney or Representative. Just wondering whether I need to fill a G-28 form for the above AP renewal application for my son since I am filling Part 9 in his application.

Yes that is true. They are lobbying strongly for H1b though they are supporting GC increases. Actually with H1b you can stay unlimited years if you apply gc. So there is no urgency for corporations to resolve the issue. They do not have fear of losing you as you are going to stay in USA until you get green card

A high number of H1-B will definitly reduce the price but still they will not get what they want meaning a permanent employee on a lesser pay. Tech companies cannot hire a person permanently because he is stuck with his employer who has filed his GC.
The companies cant continue to pay a lot to these consultanting companies.
Secondly this country should attract good brains, who might not want to come here. Believe me my friends in india are happy there and do not want to come here. They are living in there own homes with families, enjoying every part of our indian culture and are happy.
If nothing really works out here I will be looking out for an oppurtunity back home.

I work for the fortune 500 company, fragomen filed my case very last minute (just a day my 5th year finishes). I do not know why they did like that though the HR initiated my GC long time back. I found many of my friends also had similar issues. They really test your patience. One of my friend's case, they have totaly screwed up by filing last minute.

I understand that we will start getting our EADs in a year (so we would be applying for next EAD once we got current one). I understand that USCIS officers will be irritated and pissed, they will be under tons of application and everybody will be calling and bugging them. So? I realize that it maybe will take 3-4 years for us to get GC. So? I realize that DOS might retrogress now dates for many years on Oct, and will not do the same stupid mistake as making dates current and unleashing the voluntary slaves. So?
Today was little tiny success and it was day of tiny celebration. There is day for complaining and there is day for celebration.

Please do not confuse with IV objectives with the Posts with someone who is not part of core team. IV's objective is always getting MORE visa numbers.
All these Horizontal vs Vertical etc all USCIS/DOS created issues. Whoever is benefiting out of this overflow, they are happy and others are not happy.
Last year during last quarter there was heated discussions between EB3-ROW and EB India. During that time there was vertical flow and EB3ROW got more visa.
If you ask me overflow should be evenly distributed based on the backlog of a specific category.
The % of allocation should be based on the backlog.
To do this USCIS/DOS should have exact detail and have a centralized process in place. Since they don't have this and changing this is not possible in our life time, everyone is trying to suggest to change to EB2.
Achievable goals or goals worth pursuing from IVs point i guess is
a) Visa # increase
b) Making USCIS accountable for yearly visa#
- In my opinion If there is no IV then even 140K visa allotment in a year, overflow etc,etc..itself would not have happened.
Thats why Always IV moderators and core team members maintained that only way out of this mess is "to increase the visa#".

They hushed up and approved my EAD in 20 days. Why ???? 'cos So they don't hit Jun'30 and give 2 years. They wanted to milk another 680 from me so they hushed up and sent me the 1 year EAD in 20 days.

Ok, As promised I am giving you an update I contacted my attorneys office yesterday the most senior attorney was out so I spoke to her assistant and according to him, If USCIS made a mistake then its their mistake not mine once the GC card comes enjoy it and if they realized they made a mistake 3 years from now or 5 years from now well by that time my PD would probably be current so whats the difference. He did recommend I wait longer than 5 years to apply for citizenship buts thats a long way ahead. It just might be my 4th of July gift. :) I will keep you all updated on any changes.

I know that Fragomen specifically guides and runs the visa/GC related matters of Bearingpoint. They charge 10,000 dollars for a GC case and give clear cut instrucation to Bearingpoint that do not file GC till the very last moment. I left Bearingpoint (16000+ employees and offices in 43 countries...sounds great doesn't it?) because of my immigration issues caused by Fragomen. I joined a desi consulting company with 2 employess. This desi company manager took my GC file in his hand, drove to attorney office and asked him to file it ASAP. No waiting period, no nothing....
Big corporation + Fragomen is a deadly/toxic combination. Stay away from it if you can.

Credit cards are issued mostly to GC holders only unless they have a checking account as well with the institution-unless one lies in the application. -snip-.

It is true that having no prior credit record is a hindrance, but that mostly affects the credit line (you will get a small credit line). All F1 students with some kind of assistantship/scholarship/stipend would satisfy that. AmEx used to be a very good choice for students that time.
