My knowledge in this issue is limited, but looking at above posts, I have two things to tell you:
1. It may be possible to convert to EB2, clearly it is not easy and it takes time. EB3 clearly has a longer wait than EB2, but the conversion process takes time as well (even if everything is well in line, you are looking at 1.5-2 yrs at least).
2. Whether you convert to EB2 or not, chances are, you will be still in line till immigration reform comes and kicks in. Please participate in all efforts to make sure that there are some good provisions for legal immigrants in immigration reform. If all of our efforts work, you surely will get your greencard soon, whether you convert to EB2 or not.

We all know why! America decided it's smarter than anybody else: "Hey, let's let new people into the country and then exploit them for as long as possible! Well, we gotta give them some hope that that some day they would have the same rights as everybody else, but who said we need to keep the promise? There are so many ways not to: overcomplicated "process", quotas on Green Cards, processing delays, no fixed, mandatory processing times, etc." Once you realize the main goal of the immigration policy - to create permanent underclasses whom America can discriminate and exploit, everything that happened in the immigration history of USA, especially recently, becomes very logical. Unfortunately, it's a long time tradition in US to exploit and discriminate "recent" immigrants. Remember "No Irish need to apply"? How about the Chinese workers who built the transcontinental railroad and then were lynched and Chinese were effectively banned from immigrating to US for the next 70 years (see shusterman.com for more historic examples).

Press coverage in India is an excellent idea. I think this bloody american press is biased. We should all write to Indian press and highlight our issues in strong words. If we can get 100+ letters to TimesofIndia, HT, IE , NDTV, Deccan, Hindu, etc, we can highlight the discrimination and indentured servitude to the young Indian generation who has high hopes for USA. If 100+ H2B workers can stage dharna in front of an embassy/white house why cant issues of Indian people get highlighted? Lets us show the job here in the same light as slavery in middle east. I am sure David Mulford will be ringing a few phones after that.

1. If I-140 is not yet approved and withdrawn, you lose I-485/AP/EAD.
2. I am not sure why they cannot file a second I-140 based on PERM LC right away. Seems to be a no-brainer to me. Must be one of those lawyer things :)

I flew Lufthansa a couple of years ago .. the airline itself wasn't bad, but the Frankfurt airport and the customer service is horrible!

To add to that, keep following up with your lawyer. Dont assume that lawyers know everything. My lawyer destroyed my case and made me loose my 2001 labor. I have now refiled and have a 2004, a loss of 3 years, but in reality, I could have had my green card nearly 8 years ago if it had not been for the mess up. There was nothing that I could do as the company was running the show. All i could get them to do was to refile again.
In addition to the letters from co-workers, send as many paystubs that you can get, W2 forms and tax returns (or the indian version), bank statements, etc. Also include a letter along with proof that you requested a letter from your old employer.

2. We are doing white collar jobs which they are affraid we are stealing
from their sons and daughters (compare that with the toilet cleaners)
3. We get No sympathy from any side. Reason: we earn lot of money (at least
thats what they think)
4. Our issues are complex. Not many people understand retrogression
or H1B restrictions (compare that with "Hiding in the shadows" argument)

First, your scenario is overly optimistic . Even then EB3 can use a max of 10,000 of such visas and pass on the rest to the other workers category.
Which basically means Eb3s with PDs> 2004 will get screwed even in a very optimistic scenario.
Worse is Eb2s do not have such a cap . So not a drop trickles down till Eb2 is completely satiated.
Assume HR5882 gets signed by president and visas are distributed according to current laws .....Eb3 will get some benefit but not much. Infact everyone other than Eb3 will get maximum benefit including famili-based, other workers etc.
Moral of the story - Eb3s with PD > 04 ....port to Eb2 ...if you can...now

Someone referred this creditunion in this post and when i checked the rates, they seem to be better than dcu.org.
When i checked the eligibility criteria to join penfed, its vague and it seems that if i join military officers assn of america for 13dollar annual membership(which i dont need to retain) , i can get their membership. Is this correct?
If i get membership with this moaa, would that hurt my greencard process as the greencard assumes no affiliation with any military associations etc... (i remember some questions like that). Can someone please advise ?

Using H1-B or AP does not make a difference. Filing I-485 implies that you have a residence here in the US.
Having said that, typically, trips outside US that lasts less than 24 hours are not counted. That way, daily trips could be OK. However, may I ask, where do you spend your weekend?
It comes down to this question. Are you residing in US? The burden of proof is on beneficiary (I-485 applicant).
I would suggest that you should consider getting second opinion from a reputed attorney.

I think it will effect cases that are not adjudicated also. However u better check with ur lawyer.
Typically, any new regulations will affect new petitions, historically USCIS did not touch past cases for any new regulation changes.
But you are right, it doesn't hurt to check with our attorneys.

There is good chance that we might loose visas this year too....with USCIS allocating resoucers to citizenship apps given the elections in november.

I got my FP done on 10/05. My 485 status changed from Approved to Initial Review on that day. I believe it's auto status change. I have my approval notice and Permanent Resident stamp on my passport. I booked infopass appointment on 11/01 to know inquire about this change.

Hi. I don't know the answer to your first question but from what's I've read, anyone who is adjusting status needs to do fingerprinting and it's done every year until greencard is approved. For your second question, a person needs to fill out I-9 form (http://www.uscis.gov/files/form/i-9.pdf) through employer to activate EAD. For your third question, you can search the threads for late june filers. You might find the answer in all their replies there. Congratulations for getting your EAD. We're still waiting for ours. :confused:

My I485 is pending, recently I have changed my address online. I also recieved confirmation letters for this address change.
After 2 weeks of address change, USCIS issued an RFE. I have not yet received it, but I just want to prepare for this.
What could be the reason for this RFE? Is it common?

There are always going to be people who can not see other people succeed.
Anyday EB2 wait times are always going to be better than EB3, so if anybody has a chance to port they should. It does not make sense to rot in EB3.
If only my employer was so helpful.

Company is ready to promote me but I am not accepting due to my EB-3. They decided to file labor for the future job which comes under EB-2. They filed it and waiting for approval.Once I get labor and 140, yes I will use EB-2 and take the promotion. How is this become an abuse, can you expalin? In my view if you get an offer for the future job in EB-2 category and not use that opportunity then that is called abusing yourself not the law.

Not sure about the purpose of this site but mine was applied on 29th April. Started seeing updates after 15th May. Got the approval update around 25th and cards on 7th (except that sp far all cards for me and my family used to arrive at same day this time they arrived on diffrerent days).
