I have US Masters and my job requires EB3 classification. I am a honors student with full scholarship ( for people who think having a masters makes them special).
I am willing to go to DC and talk to lawmakers. I am ok with the wait but there should be some movement.

I believe that the illegal immigrant issue is the sticky whicket and that section of the legislation will be slashed and burned.
For us, I think that the House will want a reduction in EB visas. They may go for removing the dependent's counting against the quota to even it out.
Just a humble opinion. IV keep up the good work and remember, you can't please all the people all the time.

If you think donations are a requirement to be the members, I have not paid IV a dime so far. Donating is not the only way to help IV. For example there is a call campaign, where you can call and leave a message as a fellow future immigrant. You can help IV that way. Please note that we are all here to have our collective voice heard by the USCIS and the government so that the immigration processes can be expedited. A whole lot of others come here to pose questions for their tricky or troubled situations and get help from the experienced. It seems that all you need to have is a civil tongue to not be banned. Is that tough to do? Even on a public Web site like this? What other choice do you leave to the administrators if that is the case?
So, please be a good samaritan and try to help others if you can OR get help from others. Otherwise, I don't see a point in being a member here.

There is nothing definite about EB1 approval (or for that matter, approval in any EB category). There are some with better credentials whose petitions got denied, and others with lesser qualifications got approved. To a large extent it will depend on your attorney's spinning skill, and to a small(?) extent also on the whims of the IO handling the petition.

Thank you for your advice. My last M.Sc. and Ph.D. is from the USA. My Ph.D. is about manufacturing of aircraft brakes with Honeywell.

As pointed out before, if your employer is unwilling to "sponsor" you (i.e., not willing to sign a support letter), then you can go only with either EB1-EA or EB2-NIW. All other categories, including EB1-OR require sponsorship from the employer. In general, the lowest non-retrogressed preference level is the best bet. At this point, I'm not interested in learning XML or XSLT, my point was that you really don't <i>need</i> all of those things, escpecially when you are first starting out. There are plenty of people who would be happy to hire someone and keep paying them to update. And PHP would work just as well as a content management system (with mySQL of course)

(1)I agree that the non availability has to be from the place of jurisdiction of birth, but how about the letter from the registrar of muncipal office does this also need to be from the place of birth or it can be from the city the parents are presently residing.
(2) If affidavit signed in presence of registrar, does the registrar give a letter or he also endorses the affidavit.

It is in the bottom of the first page of I-485 application form. It says "Fill in box if G-28 is attached to represent the applicant"
Your employer or lawyer can certainly fill it in but they would need your signatures on the G-28 form. Without your signatures, no one can represent you as it is YOUR application.
I filled the 485 forms my self.
Where is the box in the right bottom in 485 which says I will be represented by attorney?? In 485 I see two locations for signature (one for applicant) and other for representative?
Can my employer sign it now (without me sending G-28??)

Reason for asking is I live in NJ. And i got an appointemt with DR. Kim in NY as i know him through somebody else.
He is also more reasonable asking around 190/-

He is definitely not reasonable if he is asking only 190/- becuase that should just be the physical. Immunization and xray might increase your cost. Check with your doc.

I married to a gal in 2007 during my visit to my home country but it did not work out b/w her and me due to some family reasons. (Not divorced just separated)
I came back to US in 2008 and applied for 485. My green card got approved and now my wife is in my home country and I am in US.
Now my wife and I have reconciled and I want to bring her to US.
Can I apply for her Green card and bring back to US ASAP w/o waiting for 5 years as I married before approval of my GC. I can get papers from my home country showing that I got married way before my GC approval.
I did not show at any stage in GC application that I was ever married. I thought the marriage is gone so why show it and now it could hurt me. I even dont remember if there was any question regarding marital status on 485 application.
Please help me other wise I would just have to cancel my GC and go back to H1 to bring my wife here. I cant leave her any more with our stupid relatives who might again break our marriage.

Filing seperately is probably not a good option. Since spouse on ITIN, means no income. Given this, the amount you loose on deductions for single will morethan offset the $600 you get.
So one should file joint, and wait for SSN and claim the rebates. I think you can claim the rebates anytime within 3 years. Just sharing what I read in other related threads before and made sense to me.
All said, I still don't know why they ask SSN. Some say for better disbursement of funds etc. But that doesn't make any sense to me. They always make life harder for aliens. Probably they couldn't find a solid excuse to deny rebates to H1B-SSN's. Otherwise this would have been a bigger curse. Most of us got lucky, or they just felt spouses with SSN more likely either both working or primary contributed taxes for many years, so its okay to give back some. whatever reasons behind it..

I wrote a letter with I-485 copy and said we were no where near current, and got the 1 yr EAD replaced with a 2-year one :)
