I have also seen posts by ignorant educated illiterates on IV where they advice people to do illegal things. Some of you own consulting firms or businesses and try to promote it by posting and sending Private messages. If we see such message, let us give reds and report to IV. We also need to discourage people from answering wrong info to posts where someone is illegal/out of status. All this used against us.
Yes, Norman Matloff goes over IV once in a while to know whats the current "in thing", he mentioned this once in his newsletter.
He always goes after H1B, L1 and Eb visa. He never mentions about family based or even illegals because his wife is from China and came via family based visa (marriage).

So you mean I should not even think of invoking AC21 EVEN after 180 days ?
go ahead and invoke AC-21, you are not necessarily going to run into the problems that poster faced (in fact based on anecdotes on Forums the AC-21 related denials by USCIS have gone down a lot since 2005, probably because of the yates memo that came out then calrifying all this). Try to stay on H1 as long as possible though (you dont HAVE to use EAD to invoke AC-21 and change jobs).
At the end of the day a lot depends on your luck. Some people get unlucky and end up with all this nonsense, some people end up getting caught in namecheck... they are both thankfully a small percentage of the cases, so dont let your career choices be decided by what USCIS might do. Take precautions where possible (staying on H1 etc) but do what you think is right for your career and family. The whole point of this AC-21 clause was to provide flexibility to the employee, make use of it.

But consider the below scenarios.
- A person is on his 5th Year of H1 and his I-485 gets rejected - he can go back to H1 (Since he has 1 year left).
- A person has exhausted his 6 years (May be in his 7th year). Now his I-485 gets rejected - he cannot go back to H1 (Since he has exhausted his 6 years on H1).
Not sure if my understanding is right here

I am an Indian National residing in US for the past 10 years.
My labor was filed in September 2006 under Eb3. I received my EAD in 2007 and my current legal status is EAD. Since 2006, I am with the same employer.
In 2008, I got promoted to a Managerial position which requires Bachelors and
minimum 5 yrs progressive experience. I also have a Masters degree in the same field.
I want to port my application to EB2
1. Will this result in me loosing my EAD?
2. What will happen if there is a problem with the new EB2 application - will it also impact the EB3 application?
3. Is it better to change companies to do the porting?
Please advice.

It will be better if you use your in house staff for this. No need tp pay lawyer fees. Afterall its just a form. For straight forward cases, your staff can do all the documentation and I-129 filing.
Actually %age vs salary depends on your billing multiple. The % age may work out better for employees if overtime is involved and employees get to charge overtime unless you are paying overtime to salaried employees as well.

This is just a simple forum;, me NOT completing my profile is not going to create any financial or any other type of loss FOR ANYONE. But the Doctor missing this important thing will now, in total cost me, about $1300 (which includes costs related to tests and travel etc). I could go on....

I really like these ideas and strongly feel that this would work. I myself have just now decided to take upon me to register at least 6 members by next week. Core members give a thought abt these ideas. Also put up a request on the registration page to spread the word and get at least two other people registered.
As I am writing, I understand there are 1900 active members and 5800 members. Even if 50% of the members bring one new member each, there will be a tremendous increase. And this can be done via internet: web and emails. Set a target (50% increase?),deadline (Oct 31st?) and have weekly count of new additions displayed prominently. Democrats did that for Howard Dean's campaign and the model has been used for subsequent elections by both the parties..
IV core had been very voiceferous, when we needed to achieve the funding target in summer. Can they become more involved chalking out a plan to
increase membership, if that really matters? In the membership enrollment form, if there is a field asking if some old members brought the applicant in, then we would know how many old ones really care to do something. Without personal outreach and contact, the rate of new additions will never increase.

Dont you get it. berkleybee was a great asset to IV as a core team. Atleast I felt so. Her/his analysis and post on IV were great. All of a sudden BB disappeared from IV.
So I figured BB and IV did not fell out. I for one have great regard for BB and will any day trust his/her analysis.
IMHO IV would have been much stronger with Raz4u , BB etc.
They just vanished.

In general it should not affect the visa bulletin because even if people lose jobs they can potentially scramble and get something soon enough (esp if they are on EAD). A future job offer is enough to maintain status atleast.
So for all the people already in the queue, its possible to stay in the queue even if the economy tanks.
For people not yet in the queue, even if they are forced to return to their home countries, they dont impact the existing queue.

For 1. I will be having the marriage certificate at the time of filing, which will be in July. That time my spouse will be in India, as she will apply for her H4 and then come (latest by August). What I wanted to know is that if my PD is NOV 2006, doesn't that make me current. I know people are saying that visa numbers may not be availabe in Sep, but if all PD are current till June 2007, and if my wife will get my PD, what difference does it make if she files in Aug or Dec 2007. What will happen in Dec that will not let her file I-485. I am meeting my attorney next week, but with the pathetic interview scheduling system, it would be good to know so I can get an earlier date for her.

Your priority date is Nov 06, so you can file now, but by the time your spouse is in US, the dates may retrogress (for example, lets say for discussion sakes - Jan 06). You should make sure that your employer is willing to support you. I dont know what kind of employer you have so cant speak about it. I moved to EAD and my employer fully supports me........be it 140 be it h1b or w/e. I have always helped him via sending people to join the company and now its his turn to give it back to me........so one has to evaluate his situation and then deicde.....

For the West coast I would pick the SanFrancisco Marathon (Just to be sure that gsc999 participates :p) on August 03'rd. The participants of this event can choose either a 5k, half marathon or a full marathon. This event should be fun to be part of. We have lot of committed members in our No.Cal chapter.
I would love to take the lead with this project. I have done a fund raising initiative for Arthritis Foundation of America when I ran the Mardi Gras Marathon in honor of my mom. I raised $1,100 in a 6 month period for the AFA. The idea I have is that Team IV members will participate at their local events and we should pick 3 national events such as the Chicago Marathon/Half Marathon, the Breakers 10K (is that San Diego?) and even the Crescent City Classic 10K right here in my hometown. Team IV should be well represented at these 3 national events.
Team IV members can set up an e-mail support group when training for any events. There are numerous on-line training guides which we can use. And I can also look into the idea of an on-line training coach.
I already have the committment from 4 friends, all of whom are US Citizens, to join this Team because they support our cause.
