Doesn't it sound rude... they celebrate, feast and we fast. If we admire this country for giving us so much we should also show our support and adopt the culture and celebrate with them to show we are tax paying Americans who enjoy in American way.
We can show our protest by sending 1-wish for our own GC ( may be in the form of Christmas tree ornament) to all law makers. Everybody makes a wish and our wish is GC.

You'd certainly find the poetic notion in the constitution that "all men are created equal" but if the purpose of the US government and its agencies didn't allow them to balance this with protecting the interests of the US public, a billion people from around the world would move in tomorrow. By your logic, an illegal or one with visitor visa would apply to a job he's qualified to here then sue USCIS because their stupid rules that do do not treat him equally like all other men cost him the job.. Congress enacted the INA (Immigration and Naturalization Act) and tasked USCIS to enforce it.. I researched Title VII and the INA in my paper (so much fine print than the highlights u mentioned) and can tell you that title VII specifically allows INA to override it in matters relating to Immigration, and in many cases INA obliges and in many cases walks all over the EEO and all men equal concepts.. as i discussed with my employment law professor who had a good background in immigration, the situation can't be changed without rewriting Title VII and the INA..
Anyway, just my professor's opinion and mine, u have every right to disagree but plz let's do something instead of talking..

I therefore believe there is a good chance at the Supreme Court ruling that because of long wait times of more than 3 years for a Green Card plus requirement of same or similar job during that long wait until the green card is received plus country quota affecting people born only in few countries leads to disadvantage for people of these few countries at work.
And yes, even I took law course and gave a seminar during my MBA. But even you would concur that this course at best is basic and does not make a person authority of the US legal system.
Finally, forget me or you, even a lawyer cannot say for sure what the final ruling will be in any case. And hence the best a person can do is give an educated opinion. In addition by human nature, the way I would interpret laws would be to my advantage while the way you would interpret them would be to your advantage. And hence I can understand your biases (and mine as well) because in case the country quota is found illegal by the US Supreme Court, it is the ROW that is going to be affected the most.

I agree with concept of sending ac21 letter but there are similar experiences that this letter is ofcourse of hardly any consideration.
AC21 is a law, if erraneously denied it should be opened by MTR...as ppl have underlined , it doesnt matter whether a person used EAD or H1B. This whole discussion is triggered by employer revoking 140 not becoz USCIS is denying due to I129. Its all in the IO if hez not aware of AC21 thats our trouble begines. :( but i have not heard of any failure of AC21 MTR so far ...

for all those who complain, and say the IV core doesn't do anything. the very reason you are expression your opinions, and most everyone getting advise is because the IV core took pains to set up this forum. It takes great deal of effort, time, money, sacrifice to do something productive and useful for the masses.
If you are too much worried or frustrated with the IV core not sharing info with you, why don't you take the pain of starting a forum of your own, and see how many people will join that. You will understand what all pain you will go through.
Personally I am a donor, because I understand the sacrifice people make to get this thing going. I know nobody is making money out of my donation 'coz they'll be in deep trouble for doing that. And I am not going to complain because I am not being informed of all the actions going behind the scene. I trust the core for doing the right thing which is beneficial to all. I have a H1B visa and was in US for 2 months. Now im back in India.
I got H1B visa from a no 1 company in India. Can i go to US again for another company using the same H1B visa. Can i do a H1B visa transfer from India.

Enough said, let's look for positive things to do.

Suppose I initially worked as an Engineer, and got labor and I-140 approved. Now, say I totally change my field to become a Business Development Manager, can I still port the older PD from the previous I-140 (assuming that a new labor and 140 will need to be filed for the new job) or does the job have to be same or similar for me to port the older PD?
Any inputs? Thanks!

What are we supposed to do now?? we should make this an IV campaign issue. USCIS is not following the rules set by congress. AC-21 is the law and USCIS is not following the law and causing hassel to the legal immigrant community. The legal immigrant community should really do something about this.
I will wait for Denial notice. My attorney might get it mid next week if USCIS send it today.

I am one of many many and happy to see this development.
I am puzzled.
Just would like to remind you all , only couple of months back, there was a great optimizm of CIR .. but today we know it is in stalemate.
So I think this time around we should be cautious. I have a question... What is the gaurantee that this bill is not to increase H1-B alone? Sorry If I am not being optimistic here.
I request, Our web faxes clearly state why we support SKILL BILL... If I read right and remember it well, this Forums goal is to reduce retrogression/backlogs.
Now to be positive I am copying an extract that was in quotes in press release ..
“To our detriment, current policy mandates that we educate and train these brilliant individuals and then send them away to other countries to compete against us.”

There are good chances that congress increase H1 quota and we end up supporting the wrong cause. As far as IV is concerned, I would even go to the extent of saying that we should not support H1 causes, as there are enough candidates in H1 here undergoing EB problems. Thanks for bringing out an excellent point regarding this bill. My opinion is, if EB issues are not stressed properly, this bill will be viewed as "INCREASE FOR H1B BILL".. my 2 cents.
