There is no problem in TX. My H1B is expiring in Dec 2006. I got New Drivers License upto Apr 2013.
But, for H4, they wanted to see visa stamped. There is no relation between H1 / H4 / I94 validity dates to issue.

My 485 was apporved in July 2010 and have not recieved the card yet. I have contacted with couple of Service Request for non-delivery of permanent cards. First reply from USCIS was that my case was waiting for finger printing information from my local USICS was backlogged for appointments. So, I have told to wait for 60 days for either FP notice or physical green card. After 60 days, I have called them and another service request was created and the reply was completely irrelavant as they says my address was updated for my query about non-delivery of GC.
Is there any other escalation request that I can made for deliveriy the GC or the FP notice? whenever I called the USICS are creating the SR and have to wait for answers like above.
I have recieved the 485 approval notices (for both of us) on July itself but waiting for cards now. Are anyone with the same boat ? Or Is the unusual case?

This is completely wrong. Once you are in EAD and got laid off...you lose your status. There is one more thread in this forum where one guy applied for unemployed benefit in EAD, in a weeks times the ICE was coming to his home and severed the notice to appear in the court. That guy started the thread and every one bashing him for applying the unemployment benefit. But he later came to know that his employer notified the USCIS that he got laid off during EAD. So he lost his status and they wanted to deport him. I am not sure about the outcome. He is here in only in the IV. That thread was created in the last 2-3 months time. So search for it.
There is definitely some legal implication otherwise why your employer wants to inform USCIS. They wanted to be in the safer side. So if anything happens you are the one going to face the music. So check with some good attorney.

I also reached this conclusion that....GC perm apps right now in the first 9 immigration calendar months is at an all time low and if this is indicator for future then huge ROW numbers would be going waste and by law they then will percolate to retrogressed countries like India and China and I also foresee huge PD moving in 2009-2010 calendar yr starting Oct 1 2010. I think they will increase quarter by quarter rather than month by month and by this time next year many people might get their GCs.
Yes this is a serious plus point and ofcourse yes having jobs intact during this period would be the key...so given that is OK then GCs should start coming...I agree with beautiful mind

Law comes from three sources:
Comman Law: Laws inherited from the british justice system (evolved over centuries).
Legislative Law: Laws passed by congress and signed by the Prez.
Regulatory Law: Regulations created by the regulatory agencies to implement the laws made by congress. Congres doesn't always finalize all the details to the last comma and leaves that work the relevant government agency. For example, FCC, SEC create regulations about how the congress' laws are to implemented. These regulations have to conform the laws passed by congress. These regulations have the force of law.
So when congress did not stipulate any specific overflow mechanism, it left it completely up to USCIS to work that out.
Historically EB2-RoW overflowed to EB2-India and EB3-Row overflowed to EB3-India. Soon after EB3-RoW was retrogressed, USCIS channelled EB2-RoW to EB3-RoW. This is expected to continue till EB3-RoW becomes current itself.
Therefore, if you're looking for any progress in PD, whether EB2 or EB3, the key parameter you should be watching is EB3-RoW cut-off. Only when this becomes current, others can even _think_ of nirvana. Without overflow of RoW's, both EB2-India and EB3-India cannot progress more than a day in every bulletin (at a average). EB3-Row moved a month and a half in Jan bulletin, which counts as a progress, however small, for everyone. That holds true -though not easy to intuit- for EB2-India as well!

There are over 339,000 people stuck in name check - this is done for naturalization and 485. I can bet you this will be the next battle because a lot people who have filed 485 will get stuck in this black hole, where this no accountability by FBI to individuals because the "client" is USCIS and last quarter there were 400 law suits (Writ of Madamus etc) to force USCIS and FBI to do their jobs. It would be best if setting time limits for name checks are included in IVs goals now itself. No point in jumping from the frying pan if one is going to eventually land in the fire. The name check snares a lot of Indians, Chinese, middle easterners, russians etc. Most people stuck in the name check have never been involved with the law - go figure the algorithm FBI uses to trawl the ocean bed!
Another thought i had was...Before all of us june,july,august folks land up in the blackhole of FBI namechecks...Can we lobby for some kind of transparency?What in the world can make them take 4 yrs to check a persons name?Can they at least maintain a website that they update as and when a name check is completed...Please core and members,do something about this...something as effective as the campaign to accept july applicants!!while they are overhauling the system let them get it right all the way!!

I saw you post regarding the case being transffered to Des Moines Iowa. My case has the exact same update as of March 19 2008. Its been like that since then. Yesterday, I spoke with an IO from NSC and she told me that my case is picked up for Extended processing. I am not sure what it means!!! I have applied for my EAD and AP renewals and asked her about the status of those in light of the pending additional processing of my I485. She told me that my EAD and AP renewals also would be held up until the additional processing is completed. On pushing again, she told me that in case my EAD is due for more than 90 days, i would have to walkin to a local center and get an interim EAD. I am inferring that it may be a pending interview call. My attroney also said the same thing. I dont have any criminal background, didnot do anything illegal in terms of immigration like being out of status or on bench.. So my best guess would be that its a pending interview. I had taken a infopass appnt last month and the officer in my local office also told me that my ead and ap renewal would not be approved until additional inquiry is completed. I am quite concerned and confused from last month as to what is wrong with my application to warrant a refusal of my EAD.
Lately, I have been observing several people have their cases transferred to Des Moines Iowa and interestingly around the 19th of the month. I am guessing USCIS moves cases around the 19th to the local offices

8/7/2007 Adjustment of Status applications filed.
8/7/2007 EAD application filed.
8/7/2007 Advance Parole application filed.
9/25/2007 USCIS Receipt Notice received.
10/23/2007 EAD approved and valid till Oct 2008.
6/20/2008 EAD renewal application filed.
Not sure when my lawyer got request for REF. However, I was asked to get more detailed information like transcripts / mark sheets with regards to AMIE. I submitted whatever my lawyer asked for.
In the mean while, my wife got a job. I asked my lawyer if it�s okay for my wife to start working and they said yes she can and there will not be any issue her visa status. My wife was on H 4.

I have created several documents and am working on a similar one as outlined below. But we need 50 people working on such items instead of one.
We have lots of ideas pouring into threads here but most are soon forgotten and not followed up on.
gc_peshwa has created a googlegroup to deal with participating on USCIS calls etc. We can add this agenda to that group to prevent creation of too many googlegroups and spreading ourselves thin. Alternatively we have a "Media" googlegroup as well which is dormant. That group could be used for this purpose.
Yes I agree, with the number of active volunteers we have in all of IV, a single group should be sufficient. we could use the other group "Media" to store documentation/PDFs mostly.
I have gone thorugh the other doc before about legal immigration.
I refered to the way the illegal reporter obtained estimates. The income tax paid is about $1.24 Billion, ITEP conservatively estimates that 50 percent of unauthorized immigrants ! are paying income taxes
as for the rest, its based on population and assumes they pay sales tax & property tax in the first place:
"# Sales tax is automatic, so it is assumed that unauthorized residents would pay sales tax at similar rates to U.S. citizens and legal immigrants with similar income levels.
# Similar to sales tax, property taxes are hard to avoid, and unauthorized immigrants are assumed to pay the same property taxes as others with the same income level. ITEP assumes that most unauthorized immigrants are renters, and only calculates the taxes paid by renters."
With the elections coming around in 2012 and campaigns sure to start in 6 months, its valuable to create documentation describing legal employment based immigration. Illlegals will be discussed many times, and its our job to also take part in those debates & message boards, whetehr its CNN or a website from LA, etc

What did your denial letter for I140 and I485 say?
My I-140 was never approved..
there was a first RFE for my exp letters,
and then there was an enquiry against Employer
and then RFE for A2P
and after answering A@P it is denied.
while it was pending, during July07 fiasco we applied for I-485.

Can't we have the website admin clean up and get rid of old items (action items, news etc) cluttering the main page of IV and put this in bold? Some of the most important and interesting action items (FOIA request, this one etc) are buried in forum threads and need to be bumped up.

it is a great idea. It takes a lot of work to organize an event like this. We will get a lot of publicity and it will be a good fund raising event as well. Would you be willing to take a lead on organizing an event for us?
I wore a IV T-Shirt and a cap when I participated in the Long Beach Half Marathon in October. A few of us in So.Cal chapter thought we will participate in a turkey Trot run with IV T shirts and caps last thanksgiving but that did not happen. I am going to register for Long Beach Half marathon this year as well and I plan on using my IV T-shirt

Are there any runners, joggers, walkers out there? Has anyone heard of running teams like Team Leukemia, Team AIDS, Race for the Cure - Team Susan G Komen??
Well, I would like to propose a Team IV. There would be a nominal fee, say $50 or $75, to join the walking/running club and you would get one running T shirt (with IV logo) to wear at local runs/walks. This way we get our name out in the community. And just like Team Leukemia, each Team IV member will conduct 1 fundraising event per quarter or per 6 months. At the end of the fundraising year, we should donate a portion of our collections to a local or national charity. The donation will come from Immigration Voice. This way, Immigration Voice members have another reason to be proud of what we bring to the plate as employment based legal immigrants.
If there is such a running/walking team out there, please let me know as I would love to join and support the cause. If there is interest to establish such a Team, please let me know.
