When I was hired last spring, I was not told about GC retrogression by my employer. I beleive they should have explained in graphic detail and if they done so I would not have left a good job and my home in Canada to move to an American nightmare.
I recently discovered that I have at least a 5 year wait as an EB-3. My teenage daughter will be too old to get a green card as a dependent and my wife is seriously depressed about not being allowed to work.
How many other people are as P-Oed as I am and is there a class action suit here?
They are legally not irresponsible....They very well know what is going on....
They are the ones who designed the whole doggone system....
At the worst you can say that they are ethically wrong...
They have no obligation to explain anything to you...
In fact some would tell you to wait for two years to file for green card and they would be well within their rights...
For a class action suit you need a credible argument.
The way the law is structured...we do not have a very good argument..
If you do find good argument let us know..I am sure there are members who would be interested...
Also who exactly would you sue ?? People have tried suing USCIS already with not much of success...
If you sue your employer..there goes your job...
The best recourse we have at present is through legislative efforts...

[QUOTE=austingc;1967464][[I]QUOTE=sammas;1967354]Probably the RFE might be related to photos not being sent. A friend of mine received a RFE for not sending the photos eventhough they are not required to be sent but he did not get any Biometrics notice.
Austingc,
What do you mean by lost in the email? What are you referring to here? I am sorry, I did not get what you are trying to mention here.
The RFE was to send the photographs. Online status also was changed to Request For Evidence and then once the photos were sent the status was changed back to resumed processing and after that the status was changed to Approved. Hope it is clear now.
Didn't you mention your friend did not receive biometrics notice? What I meant was he might not have received the biometrics notice to appear for finger print and photos. Thatswhy I said may be lost in the mail, since he did not appear for biometrics, USCIS issued an RFE to send photographs. Are you clear now?

AFAIK, those who become ligible to receive stimulus in 2008 can claim stimulus of previous year. IRS will post information - how to claim it.

Mumbai consulate.
They asked for zero documents.
I had taken a ton of documents
Salary slips
Tax returns
I129 petition copy
H1 approval
Name it I had it
But he asked me nothing
Does mumbai consulate still require you to submit documents in advance (4-5 days) of the interview date ?

We do not have one in Ohio either (I even checked Kentucky). What would be the best possible way to get updates so that we can join the initiative?

3/ How likely is it that PACE will become law?
Extremely likely. It is a bill with bipartisan support (almost equal number of Republican and Democrat co-sponsors). Plus, there is tremendous political will in Washington DC right now, cutting across party lines, to enact a legislation that will maintain Americas competitiveness in science and technology.
How come I didn't see this tremendous political will in DC??

L1 A are managerial positions. they can apply in EB1 through employer. Hence it is possible to get GC in Green Cards. What he is saying is true.
L1 A are managerial positions
L1 B are like H1B except they worked for their parent company for a period of 1 year or more out of US
L2 's get EAD within 8-12 weeks and they can start working.
But unless he uses GC and get out of that company, he wont be earning near to minimum H1 B wages.
Satyam pays L1B only 41K. that's pathetic. Same with Wipro, Infosys, TCS , they are misers for L1 and H1B for employees.

Isn't the UK issue different.
They are trying to change rules retroactively. There is no such thing going on here.
A similar stance would be if in midstream: lawmakers changed retroactively that only if the job makes more then $150,000 it is qualified for EB2; only companies with revenues of over $20 million can apply for greencards. If they changed the rules retroactively in USA which would preclude people who are already in line; then you would see massive amounts of protests.
However; what is happening in UK is not the same issue here. Same thing happened in Canada a few years ago when they changed the point system and wanted to do it for people retroactively.
Here, with retrogression in the background, a lot of mess is being cleaned up and a lot of enforcements are coming in place to curb visa abuse. It is quite interesting to see how enforcements are being done and how things will be handled because on one side job market is booming, on one side you find big and small consulting doing alll sorts of things and utilising visas, on one side you see locals (Especially older people who lost jobs and find it diffucult to find jobs because of their age). Overall, it wwould bee interesting to see what will the course of action be.
From what I understand, Retrogression is the only "retroactive measure using diplomacy" and I guess thats it. Stricter enforcements will be there but those who manage to get past, will always get past.
IVs strategists must look into a diplomatic angle to come up with mechanisms to fight retro which I think IV is currently doing and is on the track.

But they are not yet finish with the horse bill. I think Republican's Smith and King will again filibuster by trying to put in a lot of amendments to the horse's bill until the day is over. The chairperson is not doing good countering the filibustering of the Republican side.

There is a thin like between spam and high publicity. Chandu never crossed this.
Those who are yet to send the letters, please send it. Those who already sent them, please ask your friends. Those who feel more strong about GC and believe that IV can work for our benefit, print 10 copies at least and get the signatures from your friends directly.
All in all, let use +ve energy that will make this campaign successful, rather than questioning other motivated members' intentions.

How confident can Nikon users be that Nikon can maintain pace in the professional DSLR arena?
While pros are buyers for high-end DSLR, there are many serious hobbyists and rich individuals (majority?) for that market too.
What does a MAP $4,500 1D-II meant to me, a long time Nikon loyalist waiting anxiously to switch to Canon? I don't expect to get a 1D-II lower than the MAP price before 2004 year end. If I need the pixs, a $2,600 14MP Kodak 14n is extremely attractive for landscape now. I can opt for a used D1x around $2,000 too.
For a cost sensitive person like me (not can't but don't), I am NOT getting the 1D-II, and switch, not soon. Am I the extreme minority? George, the manufacturing jobs have gone to China, and more IT jobs are going to India. We are bleeding; come down here and see it yourself!
