Hi all,
I am currently working on an L1 visa. Have been in the US for 1.5 years.
A few weeks ago I wanted to change my job. Now I have an offer and the new employer is trying to sort out the visa.
Unfortunately, the H1B visas are gone for this year, and the employer can't wait until October to get me working in their team, so waiting for the new H1 visas is not an option.
After checking with their immigration attorneys, they now say the only option I have is to request an 'O' visa (they will support me).
'O' visas are available for top sportsmen, actors or scientists. The attorneys say I have a good-enough resume to apply for one (masters degree, published some articles and experience in top companies) but I still think the opportunities are not many, since I think my resume is really good but not outstanding enough for this type of visa.
My question is, how careful do I have to be when letting the company attorney to apply for a 'O' on my behalf? And specially, if the visa is denied is that going to impact my current L1 visa? I don't wanna end up with no visa at all! And also, is that going to be a 'bad record' next time I apply for a visa (probably H1)?
What about the positive case? Can I have the 'O' visa during the 2 weeks I will still work in my current company under an L1 (I have to give my company 2 weeks notice before leaving) before moving jobs?
I can't stop thinking the attorneys want the best for the company, that doesn't mean they want the best for me, so I am worried about the possibility they are applying for the visa on my behalf but not minding possible bad consequences for me if the visa is refused.

my amateur opinion would be that if you get another J1 visa after the waiver- you will need another waiver- last action is what counts!
i'm presuming we are not talking about a physician J-1 here.
there are no restrictions on foreign travel on a J1- except that it expires a lot (every year for physicians) and needs restamoing to reenter...

Guys,
I would appreciate if you could help on this.
I last entered in US using AP and currently working on EAD . My H1 is going to expire in April 2010. I am thinking of renewing it to provide a backup in case anything happens to my 485. I have to go to India in July 2010 and I would like to come back using AP. Pleass let me know which of the following option is best for me.
1. Renew my H1 now and go to India n July and come back using AP.I understand that in this case, if I have to use H1, I would have to go to India and get it stamped.
2. Come back from India in July and renew my H1 after I come back. Is this possible to renew the H1 after it expires and do they give you a I94 in this case?
Please let me know what you think. I need to decide ASAP.

Hello,
Contact a good attorney asap. Your details would most probably raise anyone's eyebrows at USCIS/DOS/ICE. Also, a lot depends on exact dates when you entered/left US and when your different applications were rcvd by respective govt egencies as these details will help you to establish that you are not in violation of any US laws. My friend has a question. His wifes H1 got approved. As of now she doesnt have job. What if she gets job in dec/Jan. There wont be any pay roll for october and november. Will this create any problem at the time of visa stamping in India if she goes for vaction later in next year.

As we all know that getting a GC in US is next to impossible with dates getting retrogressed to Jan 1 2000 and no sign or indication of it getting better in near future I'm strongly thinking to apply through AINP program for Canada immigration.
I truly believe that the comments and suggestions posted on this forum are very genuine, latest and by expert and experienced people. Believing this I am expecting all pros/cons of going ahead with Canada immigration.
If anyone had done this then please share ur exp and thoughts. The asking fees by the Attorneys is too high and that doesn't includes Canadian Govt. fees. So please suggest on this.

Hello,
Can someone give me a brief idea as to how long it takes for the USCIS to respond to an MTR? I think I read somewhere that they respond within 60 days. Is that accurate? My MTR was filed 2 months back & I have not yet heard back from the USCIS. It was filed at TSC.

MTRs can take months or years. There is no 60-day processing time. The prior poster's answer of a few years is not unusual.

My daughter is 2.5 years old and is on H4. She is receiving some modelling offers for commercials and photo prints. I understand since she is on H4 she cannot work. But can I apply for her EAD and work SSN by which she can work on these assignments?
I am looking at this purely for my daughters personal development and no big money is involved but still I dont want USCIS to think she is working even though she is on H4.

Unfortunately, there is not going to be a hard consensus and a good satisfying answer until USCIS comes out and fixes the law. The problem comes from inconsistent USCIS memoranda as to whether an employer who moonlights on EAD has "left" his employer.
AILA has recognized this inconsistency and has provided us, immigration attorneys, with guidance on arguing why the inconsistency should be construed to mean that moonlighting on EAD while preserving H-1B is ok; however, nobody can guarantee that the USCIS will agree with these arguments 100% of the time.
